These terms and conditions apply to the sale of any Online Courses. Please read these terms and conditions carefully before purchasing an Online Course .
For purchases via our website, by clicking on the “Accept” button you agree to the terms of this agreement which will bind you. If you do not agree to these terms and conditions you must cease to continue to purchase any courses from us.
1. Purchasing the courses via the Website
1.1. In order to purchase any of the courses on-line , you must register for an account with us via the Website. If you already have an account with us you can log into your account using your user name and password.
2. Fees and Payment
2.1. The Fees for the courses shall be as set out on the Website at the time you placed an order for them. The fees are set in US dollars, but upon checking out via OnePay payment gateway, it shall be credited in our local currency, Vietnam dong as to be in compliance with our government’s laws. The exchange rate is regulated by Joint Stock Commercial Bank For Foreign Trade of Vietnam at the time you check out.
2.2. Fees for the course(s) selected by you on the Website shall be debited from your credit / debit card at the time of purchase. Fees must be paid in full prior to you accessing any Online Course.
2.3. Any fees charged by your debit or credit card provider in connection with your purchase of course(s) are for your own account and Cake Jess.,JSC shall not be responsible for these.
2.4. You shall be responsible for all costs you incur in connection with your access onto any Online Course.
2.5. The fees are non-refundable in all cases.
2.6. You can pay for the course(s) via PayPal directly using your credit card without having a PayPal account.
3. Viewing the course(s)
3.1. After you successfully check out the course(s), an email will be automatically sent to the email account you use to register with cakejess.com to confirm your completed order and the link(s) to view the paid tutorial videos.
3.2. We will not be responsible for your not receiving the confirming emails from us if you provide a wrong account. The emails might go to “spam” box, so please be sure to check your spam box too.
3.3. The link(s) for viewing the paid course(s) will be automatically activated right after you successfully pay for it and you can check it in “Courses” box in your Profile on cakejess.com or you can go directly to the course, click on the lessons to view the videos and Material worksheet or to download the PDF tutorials (for Bundle PDF courses) .
3.4. You will be able to view your paid courses in all devices at any time in anywhere with connection to the Internet.
3.5. If you have any inquiries regarding the technical problems in viewing the tutorial videos, please send an email to: ask@cakejess.com. We will resolve the issue within 24 hours.
4. Intellectual Property
4.1. All Intellectual Property Rights in the Course Materials including the recipes created by the Instructors, video tutorials, images and the speeches made by Instructors are, and remain, the intellectual property of Cake Jess.,JSC whether adapted, written for or customised for the Client or not.
4.2. You are not authorised to:
(a) copy, modify, reproduce, re-publish, sell, upload, broadcast, post, transmit or distribute any of the Course Materials, recipes by Cake Jess instructors, video tutorials, writings, images, logos, Q&A answers, worksheets, signatures and graphic designs without prior written permission though you are strongly encouraged to use the learnings from the tutorials on cakejess.com for your own designs either for fun or for selling the cakes.
(b) record on video or audio tape, relay by videophone or other means the Online Course given
(c) remove any copyright or other notice of Cake Jess on the Course Materials;
(d) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
(e) share your signing in details with anyone.
Breach by you of any clause mentioned above shall allow us to immediately terminate these terms and conditions with you and cease to provide you with the access to any online courses.
5. Termination
5.1. We shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect in the event that you:
- are in breach of these terms and conditions.
- act in an aggressive, bullying, offensive, threatening or harassing manner towards any of our staff or Instructor who provides the online courses.
- attempt to gain unauthorized access to our server, spreading a virus, trojan horse, worm, time bomb, cancelbot or any other harmful components.
